Legislative Decree 286/1998, in art. 23, provides for a privileged and extra-quota entry channel reserved for foreign workers who have participated in professional and civic-linguistic training programs approved by the Ministry of Labor and Social Policies (MLPS). How can these workers be hired?
The procedure
In order to hire a foreign worker who has participated in a course authorised by the Ministry of Labour and Social Policies in the country of origin, the employer in question may request a specific authorisation through the Ali Portal, using the LFE form "Conversions outside quotas and special projects". At the time of sending the form, the correspondence of the name with those present on the lists of course participants will be checked using the relevant SILEN system.
In order to proceed with the application, the employer must present the certification that proves compliance with the contractual conditions required by current legislation for the purposes of hiring foreign workers, not being necessary to proceed with the verification of unavailability in the Employment Centers of workers present in the national territory (without prejudice to the application of art. 22 of DL 286/98).
Unless there are any reasons for this, the authorisation is automatically issued 60 days after the application is sent, with simultaneous submission to the competent Italian diplomatic/consular representation abroad. The worker may process the application for a work visa at the same Italian Consulate/Embassy and then enter Italy to carry out the work activity.
