The Constitutional Court has established that on March 11, 2026, a public hearing will be held to examine the legitimacy of Article 3-bis of Law 91/1992, as amended by Decree-Law No. 36/2025 and subsequently converted into Law No. 74/2025. At the center of the matter is the impact of the new legislation on procedures for Italian citizenship by descent, with particular attention to the constitutional guarantees that must always accompany the acquisition of status civitatis.

The Court’s intervention originates from a referral by the Court of Turin, which raised doubts about the conformity of Article 3-bis with the fundamental principles of the Italian Constitution: from the equality of citizens before the law, to the protection of acquired rights, and the criterion of reasonableness that must guide the legislature when intervening in such sensitive areas as citizenship.

Alongside this proceeding, the Court of Mantua has also raised an additional question of constitutionality concerning the same article. However, it does not appear at this stage that this request will be examined during the March hearing, leaving open the possibility of a future review in a separate session.

The Court’s ruling will play a decisive role in shaping the future of Article 3-bis and its practical applications, especially for those claiming Italian citizenship by descent and who fear potential limitations or changes to current rights. As customary, the outcome will not be immediate: the final decision may only be issued several months after the hearing.
