The residence permit provided for in art. 27, letter i-bis, of Legislative Decree 286/98 is a specific type of authorization intended for workers who must move to Italy to work at the headquarters of Italian companies or corporations.
Characteristics of the residence permit (art. 27, letter i-bis):
1. Recipients:
Workers who have been employed for at least 12 months (within the 48 months prior to applying for the nulla osta) in:
- companies based in Italy
- Italian companies participating in the ownership of other companies according to the latest consolidated financial statements prepared in accordance with Legislative Decree No. 9 of April 1991. 127
2. Origin:
- these companies must operate in states or territories that do not belong to the European Union
3. Purpose:
The worker must be employed in the Italian offices of the above-mentioned companies or corporations.
4. Required documents – among others:
- Contract or proof of previous employment (showing 12 months of employment within the previous 48 months)
- Consolidated financial statements of the company confirming the link with the Italian headquarters
Application procedure
1. Work authorization application:
It must be submitted by an Italian company to the competent Sportello Unico per l’Immigrazione.
2. Visa issuance:
After obtaining authorization, the worker must apply for a visa for subordinate work at the Italian Consulate in the country of origin.
3. Issuance of the residence permit:
Once in Italy, the worker must apply for a residence permit at the Police Headquarters within 8 days of entry.
