Self-employment visas

Non-EU nationals who want to start a self-employment activity in Italy can apply for a visa and residence permit for self-employment under art. 26 L.D. 286/98 - let's find out how!

Common features

No matter the type of self-employment activitiy to be carried out, the non-EU national shall in any case apply for a temporary authorization (nulla osta provvisorio) in Italy by proving the existance of the conditions that, for all the types, include the availability of an accommodation in Italy, income higher than the minimum for the exemption for the participation to healthcare contribution and the authorizations or licenses required to carry out the activity and then submitting the visa application at the Italian Embassy or Consulate in the foreign country of residence, which will have full discretion on granting the visa or not.
The self-employment visa is subject to the numerical limitation of the "decreto flussi".
Once the visa is issued, the worker shall enter Italy and apply for the residence permit which wil be issued with a 1 or 2 years duration and will be renewable as long as the conditions for its issuance are mantained and the holder has not been out of Italy for more of half of the duration of the permit. After 5 years and with legal residence in Italy the holder of a self-employment residence permit can apply for an EU long term residence permit.

CEOs and consultancy activity

Non-EU nationals appointed as directors or members of the Board of Directors (CEOs) or auditors of a company (S.r.l. / S.p.A. / S.a.p.a.) incorporated and operating in Italy for at least 3 years, that is in compliance with the payment of social security and tax charges, can apply for a visa and residence permit for self-employment demonstrating the undertaking of the company to grant them a remuneration and not establish a subordinate work relationship.
Non-EU nationals who, instead, want to carry out a consultancy activity and work as free-lancers, can apply for a self-employment visa demonstrating to have an income of at least 8,500 Euro deriving from contractual relationship with Italian clients and to satisfy the conditions to carry out the specific activity in Italy, by obtaining the relevant authorizations/licences if required.

Enterpreneurs starting a new business in Italy

Non-EU enterpreneurs who want to start a new business in Italy can apply for a self-employment visa by presenting a business plan for the development of an activity of interest for the Italian economy which includes the investment of at least 500,000 Euros, with own financial resources of lecit origin, and the creation of 3 new job positions.

Startup visa

Non-EU citizens who want to incorporate an innovative startup can apply for a self-employment visa by applying for the program "Startup Visa for Italy".
Founders must undertake to invest at least 50,000 Euro and present a solid business plan for the incorporation of an innovative startup - i.e. a company having the requisites of innovation and technology set forth by Law 221/2012 and registered in a special section of the Companies Register - and the application can be filed also through a certified incubator operating in Italy.
If the innovative startup is already incorporated, the non-EU citizen can still apply for a visa by investing an amount of Euro 100,000 and being appointed as CEO of the company.
