Law 74/2025 marked a turning point in the debate on Italian citizenship by descent and on the role of communities of Italian origin around the world. In addition to modifying the criteria for the recognition of citizenship, the reform introduced—at least in theory—new residence and work permits intended for descendants of Italians from countries characterized by historic and large-scale Italian immigration.
A promise still without implementation
During the parliamentary discussion of the reform, the government announced the creation of a residence permit for subordinate employment reserved for descendants of Italian citizens. The measure was presented as a form of compensation for the new limitations on the transmission of citizenship, including the two-generation limit and additional requirements for passing citizenship from parent to child or grandparent to grandchild. In this context, many descendants who cannot obtain an Italian passport saw this permit as a possible alternative for legally settling in Italy.
However, months later, the government has still not defined either the list of eligible countries or the administrative procedure to apply for such permits. The measure therefore remains merely an announcement without concrete implementation.
An incomplete regulatory framework
Despite the introduction of the new Article 1-octies in the Consolidated Immigration Act, the government has not yet issued the implementing decrees necessary to make this new category of permits operational. As a result, there is no official information on requirements, timelines, documentation, or available quotas.
This lack of definition fuels the suspicion that the permit for descendants was more of a political gesture—aimed at softening criticism of the citizenship reform—than a measure truly intended to be implemented.
What can descendants of Italians expect today?
At present, those interested in moving to Italy must continue relying on ordinary immigration channels or attempt to obtain recognition of Italian citizenship by descent if they meet the requirements established by law.
The residence and work permit designed specifically for descendants remains a proposal still on hold, lacking practical details and far from being a real opportunity for the millions of Italian descendants around the world. However, it is hoped that in 2026 the Italian government will proceed with issuing the implementing decrees and finally make this type of residence and work permit a reality.
